JBidWatcher: Commercial Resale


A while ago an unhappy situation arose, where someone renamed JBidwatcher, added a windows-specific installer, and was reselling the program. (On eBay in fact!)

It caused a great deal of anguish and anger when I had to ask them to stop, and I very much don't want to go through that again.

They pointed out, quite correctly, that I'm lacking a statement to the effect of requesting people to not resell JBidwatcher.

I had hoped that a disclaimer like that wouldn't be necessary, but they are right at one level, that there was nothing saying explicitly, 'No', and I can see how it might be needed for clarity.

Commercial resale is basically defined here as selling the program or its components for profit.

If you have a commercial need for a subsection of the program that you would like to ask about, or if you have a need that you feel the JBidwatcher code can meet but you'll need to resell it for some reason, please feel free to contact me, and I'll see if my employer and I can work out the legalities in a way that handles it cleanly.

Straight reselling of the program or even a collection that includes the program as the primary part, including any renaming, is really something I would really hate to see. I'm fine with JBidwatcher being a small part of a distribution CD, or magazine CD (and it has been, on several occasions). It's more when JBidwatcher is the primary value that it bothers me.

As several people have asked, this isn't an addendum to the license; it's what I think is a reasonable request by someone who has sweated thousands of hours over more than six years of development into this application. It's a labor of love, and having it sold commercially either as JBidwatcher or worse, renamed and resold, has occasionally been a severely demoralizing blow.
